The Consumer Product Safety Commission (CPSC) has extended the stay of enforcement on third-party testing and certification for lead content until December 31, 2011.

Details

The stay of enforcement pertains to total lead content in children's products (except for metal components of children's metal jewelry which already require testing) and certain related products.

The rationale for the extension is to give the CPSC more time to complete the component testing proposed rule and to make the determination on technological feasibility of the proposed 100 ppm lead limit. Also, by waiting until after the holiday season the CPSC hopes to minimize the burden on small manufacturers.

In the meantime, all manufacturers must still comply with existing lead regulations. As stated in CPSC staff's briefing package, "As a practical matter, the only way to ensure compliance with the lead limit is, at the bare minimum, an initial test of the product for lead content."

Why It Matters

While the CPSC's decision delays the third-parting testing requirement, manufacturers and retailers of children's products still must conduct appropriate quality assurance testing to help ensure that their products meet or exceed established quality and safety regulations.
